1. Rates
| 1.1 |
all rates will be
quoted in Malaysian Ringgit (RM/MYR) |
| 1.2 |
rates are inclusive
of 10% service charge and 5% government tax |

rates are subject
to change without prior notice |
2. Reservations: Booking and
Confirmation
| 2.1 |
all group and
individual inquiries by email or fax, directed to our Kota Kinabalu sales
office shall be confirmed in written |
| 2.2 |
upon acceptance and
confirmation of the booking the booking agent / private person shall pay the
deposit required on the booking; the deposit shall be paid not less than 30
days prior to departure date |
| 2.3 |
the deposit shall
in general not exceed 50 % of the total amount of the booking if booking is
to be confirmed 30 or more days prior to departure date; full payment is
required for bookings less than 30 days prior to departure |
| 2.4 |
the outstanding
balance shall be settled no less than 25 days prior to the departure of the
group or individual |
| 2.5 |
bookings concerning
the climb of Mt Kinabalu and accommodation there underlie the Booking and
Cancellation Policy laid out by ‘Sutera Sanctuary Lodges’,
whereby every booking has to be fully prepaid within seven days of the
reservation to make full confirmation and to guarantee the climb |
| 2.6 |
upon payment of the
deposit the booking agent / private person enters a legal contract with The
Flying Dusun Sdn Bhd and accepts fully the understated cancellation policy |
| 2.7 |
no booking will be
confirmed without full payment prior to the departure of group or individual |

4. Cancellation Policy
| 4.1 |
the full deposit
minus RM 100.00 shall be refunded if cancellation occurs within the first 15
days, i.e. before payment of the full amount of the booking |
| 4.2 |
be notified that
your booking will be cancelled and your deposit minus RM 100.00 shall be
refunded if no further payment 15 days prior to departure date of the group
or individual follows |
| 4.3 |
if cancellation
occurs within 15-8 days prior to departure of group or individual, 50% of
the total amount of the booking will be charged to you |
| 4.4 |
if cancellation
occurs within 7-3 days prior to departure of group or individual, 80% of the
total amount of the booking will be charged to you |
| 4.5 |
there shall not be
any refund for cancellations 2 days prior to departure of group or
individual |
| 4.6 |
there shall not be
any refund for ‘no-show’ of individuals or groups |
| 4.7 |
arrangements to
climb Mt Kinabalu underlie the cancellation policy laid out by ‘Sutera
Sanctuary Lodges’. Cancellations concerning accommodation at the Sabah Parks
will not entitle to full refund of booking |
our
cancellation policy is a guideline; we will always try to reimburse you as much
as we can retaining only a nominal service fee (RM 100) but there are cases
where we will have prepaid accommodation/services to secure your tour and
reimbursements will depend on what is reimbursed to us; in no case cancellation
fees will exceed the above guidelines
5.
Groups
| 5.1 |
any party larger
than 12 participants is considered a group |
| 5.2 |
special rates may
apply, but the booking and cancellation policy remain the same |
| 5.3 |
for any 21
participants there shall be one person free of charge, but there shall not
be more than 4 persons free of charge |
in accordance
with our company philosophy and to maximise your experience when travelling with
the Flying Dusun we suggest that groups do not exceed 6 participants
6.
Insurance
| 6.1 |
the Flying Dusun
does not provide any insurance. It is highly recommended that participants
in any organised tour take out additional insurance at home, at their own
expense, to cover such things as tour and travel cancellation /
interruption, personal accident, health and medical, hospitalisation,
property loss and theft etc. We further suggest that you sign up with
TravelCare, a comprehensive emergency service provider in Malaysia ensuring
that you will not have any cash expenses in case of untoward incident while
travelling in Malaysia |
| 6.2 |
only for climbing
Mt Kinabalu the organiser of the tour takes out a climber’s insurance
(obligatory and included in the tour price) with Sabah Parks, and climbers
are insured (limited accident insurance; does not replace your traveller's
insurance) |
| 6.3 |
The Flying Dusun
Sdn Bhd and its contractors and/or associates, agents and employees cannot
be held responsible for injuries, damage, loss and theft. Participants,
drivers and passengers, their heirs, successors, and assignors agree to
release, indemnify and hold The Flying Dusun Sdn Bhd, its agents,
contractors and employees harmless from any and all liability or claims
directly or indirectly related to the participation of a tour |
| 6.4 |
Jurisdiction – the
agreement between The Flying Dusun Sdn Bhd and the booking agent /
individual participants shall be deemed to be made in Malaysia and in the
event of disputes shall be decided in accordance with the law of contract
and general laws in Malaysia. The parties herein agree that in the event of
any dispute they will subject themselves to the courts of Malaysia. The
parties herein agree to be bound by their decisions including all decrees
and orders, interim of otherwise and specifically also to recovery
proceedings |
